Welcome to Butterscösh. This website, operated by Butterscösh ("we", "us", or "our"), provides access to our products and services subject to the following Terms & Conditions. By using our website (www.butterscosh.in) and placing an order, you agree to be legally bound by these.

Eligibility

You must be at least 18 years of age to use this website and make purchases. If you are under 18, you may use the site only under the supervision and guidance of a parent or legal guardian.

Account Creation and Security

When you place an order on our website, a customer account is automatically created using the email and mobile number provided at checkout. The registered email becomes your primary account identifier which cannot be modified later. Other details such as name and addresses may be added or modified at any time by logging in and visiting the "Profile" section.

To enhance both convenience and security, Butterscösh uses a one-time password (OTP) based login only. This eliminates the need to manage passwords and reduces the risk of unauthorized access. Each time you log in, an OTP will be sent to your registered email.

You are responsible for any and all activity conducted under your account. Butterscösh reserves the right to restrict, suspend, or terminate any account found to be in violation of these terms and conditions or having misused the website, products or services in any manner.

Products and Descriptions

All garments sold on our platform are designed by Butterscösh and feature our signature built-in bust support. While some styles may draw inspiration from familiar silhouettes, each piece is uniquely developed through its fabric, cut, length, trims, and most importantly, the integrated support.

The construction required to deliver the right balance of comfort, shape, and support is thoughtfully tailored by our design team, which means the internal structure can vary significantly across garments.

We make every effort to provide accurate details regarding fit, fabric, color, and styling. However, slight variations may occur due to photography lighting, screen resolution, and the inherent characteristics of certain materials. These differences will not be considered defects.

Size & Fit Disclaimer

Our sizing is tailored for Indian body proportions and informed by real customer data. Before placing your order, we recommend checking the size guide, noting how the garment fits the model, and browsing customer reviews to make an informed choice.

We suggest ordering the size closest to your actual measurements. If you're between sizes, consider your fit preferences-size up for a relaxed fit or down for a more sculpted look. Most of our fabrics offer comfortable stretch, and so our garments can accommodate variations up to 1 inch (2.5 cm) above or below the size chart. If your measurements differ significantly, we do not recommend purchasing that style.

Still unsure? Write to us at hello@butterscosh.in with your bust, waist, and hip measurements in inches (e.g., 36", 28", 38"), along with your usual bra size (e.g., 36B), and we'll be happy to assist. Please note that we do not currently offer custom sizing or garment alterations.

While we're always here to help, Butterscösh cannot be held responsible for fit concerns arising from individual body differences or personal preferences.

Pricing and Payments

All product prices are listed in Indian Rupees (INR) and include applicable taxes. We reserve the right to revise prices, promotional offers, or product availability at our discretion without prior notice.

We accept a range of secure payment methods including major credit and debit cards, UPI, net banking, and approved third-party payment gateways supported by our payment processor(s). All payments are processed through encrypted and PCI-DSS-compliant platforms, which means your financial information is protected at every step. We do not store any card or payment data on our servers, and your privacy and transaction security remain our top priority throughout the checkout process.

Cash on Delivery (COD) is also available irrespective of order value. We reserve the right to temporarily disable COD for accounts with an unusually high return rate or irregular order behavior. If this applies to your account, COD may be reinstated once consistent order acceptance and lower return frequency are observed. We reserve the right to disable COD for high-value orders or during promotional periods. Refunds for returned COD orders will be issued as store credit only, valid for one year from the date of issue. Store credit is non-transferable and cannot be converted to cash.

In the event of a failed payment or technical issue at checkout, we recommend checking your bank statement before attempting the transaction again. If a double payment is made for the same order, the duplicate amount will be refunded to the original payment method within 15 business days. If not, please write to us at hello@butterscosh.in with the transaction reference number, and we'll resolve the issue promptly.

Guarantee and Warranty

All Butterscösh products are carefully designed and quality-checked before dispatch. However, we do not offer any express or implied guarantees or warranties, including but not limited to those relating to product performance, durability, or suitability for a particular purpose. Wear and tear, fabric variation, and care-related issues are not covered under any form of guarantee or warranty.

Order Processing and Shipping

We ship to over 29,000 pin codes across India. Estimated delivery timelines are shown at checkout and may vary based on your location.

Orders are typically processed and delivered within 3-8 business days, except during promotional periods, new launches, or unforeseen delays. Once your order is confirmed, a dispatch notification with tracking details will be shared via email, SMS and/or WhatsApp.

While we aim to deliver promptly, we are not liable for shipping delays caused by weather conditions, logistical constraints, handling delays, political disruptions or other external factors beyond our control.

We offer free shipping on all orders above ₹5000. Orders below this amount incur a flat ₹200 shipping fee. Express Shipping is available for an additional fee. Orders returned to origin (RTO) will be refunded after deducting shipping and reverse logistics charges.

Returns and Exchanges

Returns and exchanges must be initiated within 7 days of delivery. Returned items must be unused, unwashed, and in their original condition with all tags and packaging intact. Once the item is returned to us, it will undergo a standard quality check (QC), and only upon QC clearance will a refund or exchange (as applicable) be processed. Otherwise, the item will be returned to you as is.

Refunds for prepaid orders are made to the original payment method within a maximum of 15 business days, subject to our payment processor's policy. Refunds for Cash on Delivery (COD) orders are issued as store credit, valid for 1 year.

If your garment(s) appear tampered with or have broken seals/tags at delivery, please notify us within 24 hours, otherwise your claim may not be considered. Items purchased at a discount or during sale periods may not be eligible for return unless received in defective condition.

Store Credit

Store credit issued by Butterscösh as part of a return or resolution process is valid for 1 year from the date of issuance. It is strictly non-transferable, non-refundable, and cannot be redeemed for cash under any circumstances.

Store credit may be used only on www.butterscosh.in and must be applied during checkout. It cannot be used across multiple accounts, transferred to another user, or combined with any other credit or promotional balance unless explicitly permitted. Store credit cannot be applied retroactively to past orders.

If the cart value exceeds the credit amount, the remaining balance must be paid using a valid payment method. If the cart value is lower, the unused balance will remain active until expiry. No extensions will be provided once store credit expires, and no reminders will be sent prior to expiration.

Any attempt to manipulate the store credit system including creating duplicate accounts, reselling store credit, or exploiting technical glitches etc. will result in immediate cancellation of the credit and potential account suspension. Butterscösh reserves the right to amend this policy or deny usage of store credit at its sole discretion in the case of suspected misuse or abuse.

Cancellations and Modifications

Orders can be cancelled or modified within 12 hours of being placed by writing to hello@butterscosh.in. Once the order is processed or shipped, cancellations are not permitted. However, you may initiate a return or exchange request after receiving the product, subject to our Return & Exchange Policy.

Promotional Codes and Offers

From time to time, Butterscösh may offer special promotions, limited-time discounts, or marketing campaigns. Each promotion is governed by its own set of specific terms and conditions, which will be clearly communicated on the relevant promotional page, email, social media post, or during checkout. By participating in any such promotion, the customer agrees to be bound by both the general Terms & Conditions and the specific terms of that promotion.

In the event of any inconsistency between the general Terms & Conditions and the terms of a particular promotion, the promotional terms shall prevail, but only for the duration and scope of that offer. Upon the conclusion of the promotion, all transactions remain subject to the general Terms & Conditions.

Promotional codes and offers are non-transferable, valid for one-time use per customer, and cannot be combined with other offers, discounts, or codes unless expressly stated.

Butterscösh reserves the right to refuse, cancel, or modify any order or promotion at its sole discretion, especially in cases of suspected misuse, fraud, or violation of promotional terms.

Content Accuracy and Availability

While we make every effort to ensure that all product details, prices, inventory status, and related content on www.butterscosh.in are accurate and up to date, occasional errors may occur due to typographical mistakes, system limitations, or human oversight.

We reserve the right, at our sole discretion, to correct any such errors, including but not limited to inaccuracies in pricing, product descriptions, sizing details, shipping estimates, or stock availability without prior notice. This includes the right to refuse or cancel any orders placed for products listed with incorrect information, regardless of whether the order has been confirmed or payment has been processed. If your payment has already been made, a full refund or store credit will be issued, as applicable.

We appreciate your understanding as we work to deliver a seamless and transparent shopping experience.

Intellectual Property

All content and materials displayed on the Butterscösh website, including but not limited to product names, photographs, illustrations, garment designs, branding elements, logos, graphics, written content, videos, packaging, page layouts, and the overall visual identity and aesthetic of the site, are the sole and exclusive intellectual property of Butterscösh.

These assets are protected under applicable Indian laws relating to copyright, trademarks, trade dress, and design rights. Any reproduction, adaptation, modification, publication, distribution, or other use whether in part or in whole without the express prior written consent of Butterscösh is strictly prohibited and may result in civil or criminal liability.

Access to or use of our website does not grant any user ownership, license, or permission to use any of our intellectual property for personal, commercial, or derivative purposes. Content may be used solely for the purposes of browsing, learning about our brand, or placing an order as intended by the platform.

We take intellectual property protection seriously and reserve the right to take appropriate legal action in response to any misuse, infringement, or unauthorized exploitation of our content, designs, or brand assets.

Privacy and Data Security

We collect only the information needed to process your orders, provide support, improve our services, and meet legal requirements. All payments are processed securely through leading third-party gateways that use encryption and fraud protection technologies. Your card details are never stored on our servers or visible to our team.

User Conduct

Any such activities will lead to appropriate legal or corrective action.

User-Generated Content

By tagging @butterscosh.in on social media or submitting reviews, testimonials, or content with photos, you grant us a royalty-free, non-exclusive, perpetual license to use, reproduce, and publicly display such content across our marketing platforms, including but not limited to our website, emails, and social media accounts. Credit will be given where feasible.

Mobile Messaging

By providing your mobile number during checkout or account creation, you consent to receive transactional messages and order updates via SMS and WhatsApp. We may also send occasional promotional messages, from which you can opt out at any time by emailing us.

Force Majeure

Butterscösh shall not be held responsible for any failure or delay in fulfilling obligations due to circumstances beyond our reasonable control. This includes but is not limited to natural disasters, acts of government, war, civil disturbances, strikes, pandemic-related disruptions, or failures of internet or logistics infrastructure.

Indemnification

By using the site, you agree to indemnify and hold harmless Butterscösh, its founders, employees, and affiliates against any claims, damages, losses, liabilities, and expenses arising from your use of the site, violation of these Terms, or infringement of third-party rights.

Limitation of Liability

Butterscösh shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of our website, services, or products. This includes, but is not limited to, loss of data, delays, service interruptions, or issues caused by third-party providers. Our liability, if any, shall be limited to the value of the product purchased.

Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from the use of our services shall fall under the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.

Modifications to Terms

Butterscösh reserves the right to modify or update these Terms & Conditions at any time without prior notice. Your continued use of the website following such changes constitutes your acceptance of the revised terms. We encourage you to revisit this page periodically.
